Detailed water modelling and weather records were used to demonstrate crop demand was greater than actual water supplied during the season the crop was produced. On behalf of the Berrigan Shire Council, prepare a detailed statement of evidence assessing the agricultural viability of a proposed non contiguous sub division. Commercial appraisal of the current and proposed lots was undertaken. Evidence was provided in the NSW Land and Environment Court to support the statement evidence. The Court ruled in favour of the Berrigan Shire Council. On behalf of a group of twenty irrigators, prepare a detailed critique of Water Sharing Plan. The critique encompassed a review of all aspects of the water sharing plan including financial comparison, the science underpinning the plan, and the entitlement reduction methodology. The report assessed the quantum of economic impact on each to assess of the Water Sharing Plan. Prepare a detailed report on behalf of an irrigator who was refused Exceptional Circumstances relief payment due to the Farm Household Support Act’s (1992) definition of exempt assets. In this circumstance the irrigator had complex business asset ownership arrangements. Centrelink had determined the main farm house was an exempt (off farm) asset and refused the application for Relief payments. This decision was subsequently affirmed upon appeal and again after review by the Social Security Appeals Tribunal. Upon submission of the expert report detailing the operation of the business and importance of the house to the farm, the decision was reversed and the irrigator was back paid to the date of the original application. 2007 Expert Referee under Part 20, Division 3 of Uniform Civil Procedure Rules for presiding Magistrate to provide substantiation final judgment. The action over conflict between landowner and contractor. Necessitated use of satellite imagery to assess old evidence. Parties settled on the basis of the report. Prepared a detailed quantum of economic loss assessment for a pastoralist in northern Australia. The loss incurred was related to the compulsory acquisition of a portion of a property of greater strategic importance to the property’s operation. Heads of Consideration were used to define all areas of loss including operational and balance sheet items. Mitigation actions were reviewed and costed. The same process as described above was undertaken in a separate matter. 2006 In relation to an estate being contested under the Family Provisions Act a critique of an Agricultural Expert’s report was carried out. In addition to the critique an assessment of viable business size for the specific area with supporting detail was prepared. Private irrigator was impacted by a disrupted water supply during a critical time in the crop production cycle. Assess quantum of economic loss.
